Perdido Key condo owners take Escambia County to court over beach access

The owners' association behind the Seafarer Condos is asking the Escambia County Circuit Court to stop the county from opening new public beach access on Perdido Key.

The Seafarer Owners Association filed a petition Dec. 14 asking the court to reverse the Escambia County Board of Adjustment's decision to approve conditional use of property near the condos for a public beach access site. The owners' association argues the county did not meet all of the requirements under its own laws to justify a conditional use approval.

Will Dunaway, attorney for the Seafarer Owner Association, wrote that the county failed to follow Florida law when the Board of Adjustment voted to grant the conditional use. Additionally, Dunaway argued that when the board made the decision, it only considered the public access use for the property and not the habitat conservation required for the site.

"They're throwing the kitchen sink at it, but none of it is going to hold any water," Commissioner Jeff Bergosh told the News Journal on Wednesday.
